Terms & Conditions

All sales made are subject to the following terms & conditions. By paying your deposit it will be deemed that the terms and conditions are accepted and applying to your order.

PRICES
All prices are non-negotiable and priced according to your exact design and the size of your cake.
Following your enquiry / consultation, your quote is valid for up to 1 month (Wedding Cakes) or 7 days (Celebration Cakes).
Paying your deposit will secure this price & the slot in the diary.

DEPOSITS
All celebration cake and wedding cake orders require a non-refundable deposit of 50% of the total cost. All other orders are required to be paid in full.
All deposits become due when the order has been placed and details checked and agreed by you. All orders are deemed to have been accepted only when the deposit has been paid.
If your deposit is not paid within 1 month (wedding cakes) or 7 days (for celebration cakes) we reserve the right to cancel any previous arrangements.
Please note that deposits are non-refundable and non- transferable.

PAYMENT
Cheques are accepted for the deposit but cannot be used as payment method for the final payment.
Final payment for wedding cakes and celebration cakes over £140 must be made at least 14 days before collection/ delivery/ set-up or as stated on your order form.
Final payment for other orders may be made on the day of collection.
Final payment can be made by same day bank transfer or by cash.

NON – PAYMENTS
In the event that any payment is subsequently declined, the order will not be completed or released until alternate funding arrangements have been agreed and payment is made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. We accept no responsibility for any loss howsoever caused for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have incurred as a result of payment failure.

CANCELLATION
If cancellation of an order takes place we reserve the right to retain your non-refundable deposit. If cancellation takes place less than seven days before the order is due we reserve the right to seek 100% of the order value.
Cancellation must be made in writing (by letter or email) and will only be deemed to take effect from the date your letter/email is received at our premises.
If you postpone the event we will endeavour to transfer your order providing the date is suitable to ourselves, otherwise it shall be treated as a cancellation.
We retain the right to cancel the booking in very unusual circumstances beyond our control, such as fire or ill health, during which we will refund any money taken in full.

DESIGN
ALTERATIONS & CHANGES
Your cake is important to us. Please take the time to check your quote thoroughly and lets us know within 3 days if changes are needed. It is your responsibility to advise us of any alterations to the original order.
If requested, we will endeavour to adjust the design where possible according to the nature of the request or amount of notice given. If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly.
We reserve the right to change the design at any point if circumstances beyond our control may compromise the quality of the finished cake, e.g. melting due to hot weather.

CHOCOLATE OR BUTTERCREAM
We recommend extreme caution if you are considering a celebration or wedding cake decorated with chocolate or buttercream for a summer event ( May – September ). We cannot accept responsibility for any melting of the cake once it has left our possession, as we have no control over the environment/venue.

FLOWERS
We cannot take any responsibility for any damage rendered to the cake caused by a floral arrangement or flowers that was implemented by your florist or other parties. You acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt or other contaminants.

ALLERGIES & SPECIAL DIETARY REQUIREMENTS
Please discuss with us if any of your guests have special dietary requirements. Cakes can be made gluten / dairy / egg / alcohol free.
Please be aware that although nuts can be omitted from cake recipes, they are still used in our kitchen so we cannot guarantee that any of our cakes are completely free of them.

NON – EDIBLE ITEMS
Most cakes contain small proportions of inedible items; it is the client’s responsibility to ensure that they are removed by your caterer / guests before consumption e.g. Support dowels in tiered and structured cakes, ribbon, wires in sugar flowers, flower picks, flower tape, Swarovski crystals etc.
You will be advised on the position of any support structure or non edible items used.

DELIVERY CONDITIONS
Delivery charges are calculated on a mileage and time basis. Alternatively cakes can be collected from our premises.
COLLECTION
Your order may be collected at a pre-arranged time. A signature is required upon the collection confirming that you have received your order in good condition and as specified.
If you are collecting a wedding cake please check that your wedding insurance covers any cake damage.
You will be advised on the best way to transport your cake.

DELIVERY
If you choose delivery, it is our intention that your cake will be delivered in perfect condition prior to the start of your event. However we ask for patience with factors which may be out of our control (e.g. traffic conditions) as we cannot be held liable for any such delays. In the unlikely event of a late delivery, the maximum compensation will be the refund of the delivery price.
It is the customer’s responsibility to ensure that you have given us the correct delivery information, and that some one is available to receive, inspect and sign for your cake on delivery.
If the recipients are not in, the order will be returned to ourselves and we will contact you to arrange an alternative delivery time for which an additional charge will be payable by the customer. We accept no responsibility for any loss or consequential loss incurred by the customer as a result, e.g. a wedding without a cake.

FORCE MAJEURE
Neither we, nor any courier or postal service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstance outside our reasonable control including but not limited to any, fire, flood, explosion, accident, adverse weather conditions, earthquake, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God or from any industrial dispute or strike, whatsoever.

CAKE SET UP
If cake set up has been requested it is your responsibility to ensure that you have provided us with the set up details and arrangements made with the venue for the location and display of your cake. We cannot be held responsible for the location of the cake at the venue. Please ensure therefore that the display location is level, stable and strong enough to hold the cake.
Please also remember that chocolate covered cakes can melt in warm conditions such as inside a marquee on a hot summer day, or when set up in direct sunlight.
If a cake is to be delivered and set up by us, a signature will be required from your venue management confirming the cake has been received and set up in good condition. A photograph of the cake will be taken prior to departure by us to verify that the cake has been set up and left in good condition.
We cannot be held liable for any damage that is rendered to the cake at the venue once we have left the premises.

COMPLAINTS
We want you to be happy with your cake and strive achieve customer satisfaction. In the event that you are not happy with your cake please speak to us at the time of collection or delivery and we will try to rectify any problems. If you are not available and you have not nominated anyone to accept delivery, the staff at your venue will be responsible for checking the cake’s condition.
Any refunds given for disputes regarding a cake design or production of a design are completely at the discretion of Tumble Tiers and are not automatic.
After delivery if you have any complaints please get in touch as soon as possible. A refund will only be considered if the cake is returned to Tumble Tiers within 24hrs in order that we may assess the nature of the complaint. Depending upon the fault with the cake, a refund may be given. Maximum liability is the cost of the cake.
Refunds will never be given for any cake which has been consumed regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied.

STORAGE & CONSUMPTION
DAMAGE
Please remember that cake decorations are very delicate items and we cannot accept responsibility for damage that is done after it has left our possession.
If any damage is rendered to the cake after it has left our possession, then you can advise us and request a repair, which will be costed accordingly, including transport costs if appropriate.

PORTION GUIDE
Our portion guides are intended as a guide only. This will vary dependant upon how the chef cuts the cake.

BEST BEFORE DATE / STORAGE CONDITIONS
Your cake is baked to ensure it is fresh for the date of your event, we cannot guarantee its quality if it’s consumed more than 48 hours after the event. Our cakes are made entirely of natural ingredients, so because of this they will not have the shelf life of supermarket cakes, which contain additives and preservatives to ensure their prolonged life. Freezing the cake however, preserves the taste of the sponge and icing as much as feasibly possible, please bear in mind that it will affect the visual appearance of the icing as condensation will appear on defrosting.
Food hygiene recommendations recommend that food should only be frozen for a maximum of 3 months.

If you plan to keep any of the cake tiers, please advise us what cake boxes you would like to be left on site to transport the cakes home. Otherwise we shall remove all cake boxes from the venue to ensure we leave it as tidy as possible.

RETURN OF HIRED EQUIPMENT
Refundable deposits are taken for all equipment. All equipment must be returned within 3 days of the event date (unless alternate arrangements have been agreed prior to the event and confirmed in writing), or extra charges may be levied to cover hire costs. Any damage to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.

COPYRIGHT AND PHOTOGRAPHY
All cakes provided by Tumble Tiers are subject to copyright however photographs may be taken for personal use. Tumble Tiers reserves the right to use any image of your cake for marketing and advertising purposes. Your cake will not be displayed on any website or social media platform until it has been seen by your guests. If you would like to submit photos of your cake to any magazines or similar please let us know – we are usually delighted to be included!

Tumble Tiers do not sell customers data.
